Member states, in this respect, “face the choice of whether to perform the desired functions ‘in-house,’ or to ‘outsource’ them” (Tallberg 2002a: 25). The benefits of delegation must be sought in the ability of EU bureaucracies to lower the transaction costs of cooperation, 20 Delegation and Agency in International Relations 21 while delegation at the same time inevitably results in some sovereignty costs. Studying the delegation process is critical, as it tells us something about the institutional setting in which EU bureaucracies operate, and the strategic resources that they have at their disposal.

This implies that member states are unlikely to delegate many formal competences to the EU bureaucracies in the CSDP (Wagner 2003; Majone 2001; Tallberg 2002a). Agents guaranteeing commitments of member states have to stand above the principals and thus require formal autonomy. When agents facilitate the process in order to achieve efficiency gains, formal competences are less important. Member states are consequently unlikely to delegate to Delegation and Agency in International Relations 37 the EU bureaucracies formal powers in foreign policy.

This leads to two problems: differences in the interpretation of agreements and the need for secondary agreements. Both have distributive effects in terms Delegation and Agency in International Relations 29 of payoffs. Interpretation is likely to be a zero-sum game, in which one member state wins and another member state loses. Secondary agreements are more complicated. Unlike primary agreements, to which member states sign up voluntarily, they do not necessarily yield positive payoffs for all the member states.
